1. Agreement
These terms govern your use of the Hotel Owners Community platform. By creating an account or using the platform you agree to them. The platform is operated by Reliance Advisors & Merchant Services LLC, 614 Cranbury Road, Suite 365, East Brunswick, NJ 08816 (“HOC”, “we”, “us”).
2. Membership
2.1 Tiers
HOC offers a free Individual Owner membership and a paid Portfolio Pro membership. Individual Owner membership provides access to the platform, your member record and general community resources. Portfolio Pro provides the additional benefits described on the membership page at the time you subscribe, which currently include access to the approved insurance programme, the legal counsel benefit, third party administration and real estate advisory.
The approved insurance programme is delivered through Reliance RAMS and covers Property, General Liability, Umbrella, Employment Practices Liability (EPLI) and Cyber. The benefits set out on the membership page at the time you subscribe are the ones that apply to your membership.
2.2 Fees and renewal
Portfolio Pro is charged at USD 2,000 per year for each property enrolled. Fees are billed annually in advance and renew automatically each year for the same period unless you cancel before the renewal date.
We will charge the payment method you have saved. Where the payment processor applies a processing fee, that fee is shown to you before you confirm and is added to the amount charged. Bank transfer and card carry different fees and you may choose between them.
If a renewal payment fails we will attempt it again and we will let you know. If payment has not succeeded after those attempts, membership benefits may be suspended until the balance is settled.
Fees are not refundable except where required by law or expressly stated.
2.3 Cancellation
You may cancel at any time with effect from the end of the period you have paid for. We may suspend or end a membership if these terms are breached, if fees remain unpaid, or if continuing would put HOC or its members at risk.
3. Your account
You are responsible for the accuracy of the information you provide and for keeping your login secure. You may invite other people, such as a general manager, a family member or a member of staff, to access your account at the level of access you choose. You remain responsible for what they do on your account.
You must tell us promptly if you believe your account has been accessed without your permission.
4. What the platform is, and what it is not
This is the most important section of these terms and we ask you to read it carefully.
The platform displays information about your insurance. It is a convenience, not the policy itself. Your cover is determined solely by the policy documents issued by your carrier. If anything shown on the platform differs from your policy, the policy governs.
Reporting an incident on the platform is not the filing of a claim and does not put your carrier on notice. It tells the HOC and RAMS team so that we can contact you and handle it properly. If a matter requires urgent notification, contact us directly rather than relying on the platform.
The AI assistant provides general assistance only. It can be wrong. Do not rely on it to determine whether something is covered. Coverage questions should be directed to a licensed person at RAMS.
Crime scores, savings figures, guest ratings and similar indicators are estimates derived from third party or benchmark data. They are provided for orientation and should not be relied on as the sole basis for a business decision.
Weather and other alerts are provided as a courtesy on a best efforts basis. They depend on third party data and on delivery by email, text or messaging services outside our control. They may be delayed, incomplete or fail to arrive. Do not rely on them as your only means of learning about a severe weather event or any other emergency, and always follow official guidance from the National Weather Service and local authorities.
5. The legal consultation benefit
Portfolio Pro members may be entitled to a complimentary consultation of up to one hour per year with an attorney introduced through HOC. That consultation is provided by the attorney and not by HOC, is for matters other than insurance coverage disputes, and creates a relationship between you and the attorney rather than between you and HOC. HOC does not provide legal advice, does not supervise the advice given, and is not responsible for it. We record only that a consultation took place, for the purpose of tracking your entitlement.
6. Documents and content you provide
You keep ownership of everything you upload. You grant us the right to store it, display it back to you and to those you have authorised, and to share it with carriers, producers and advisers where necessary to provide the services you have asked for.
You must not upload anything you do not have the right to share, anything unlawful, or anything containing malicious code.
7. Vendors, lenders and third parties
HOC may introduce you to vendors, lenders, payment providers and other third parties. Any agreement you enter into with them is between you and them. We do not guarantee their services, pricing or performance, and we are not a party to those arrangements.
8. Referrals
Where HOC offers a referral reward, the reward applies only when the referred party becomes a paying member and remains one, is applied as a credit against membership fees rather than paid in cash, and may not be combined with another offer. The reward amount and the conditions attached to it are those stated in the referral offer at the time you make the referral. We may vary or withdraw the programme, and any change will not affect a reward already earned.
9. Availability
We aim to keep the platform available but we do not guarantee uninterrupted access. We may suspend it for maintenance, and we may change or withdraw features. Where a change materially reduces what you have paid for, we will tell you in advance.
10. Our responsibility to you
The platform is provided on an “as is” basis. To the fullest extent permitted by law we exclude implied warranties, including of merchantability, fitness for a particular purpose and non infringement.
We are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data. Our total liability arising from the platform in any twelve month period is limited to the amount you paid to HOC for membership during that period. Nothing in these terms limits liability that cannot be limited by law.
Nothing in these terms limits or varies the obligations owed to you by an insurance carrier under a policy, or by RAMS in its capacity as your producer.
11. Indemnity
You agree to indemnify HOC against claims arising from your misuse of the platform, from information you provide that is inaccurate or that you were not entitled to share, and from your breach of these terms.
12. Changes
We may change these terms. Where a change is material we will give notice through the platform or by email before it takes effect. Continuing to use the platform after that point means you accept the change.
13. Governing law
These terms are governed by the laws of the State of New Jersey, and the courts of New Jersey have exclusive jurisdiction, save that either party may seek injunctive relief in any competent court.
